Attachment of Earning
Attachment of earning is a legal procedure in civil litigation by which a defendant's wages or other earnings is used to payoff the debts. These kind of collection process with legal bounding are widespread law system, especially in the UK .
There is a remark in Ballentine's Law Dictionary that this process is not factual, whereby the property of the borrower is figuratively brought into the court. An attachment of earning order can prevent money being paid to a defendant. The earnings held may be salary, certain benefits, or sales commissions.
There is a norm before you can ask the court to issue an attachment of earnings order only if the defendant is lacking at least one-payment and have arrears and the amount should not be less than £50. Before asking for an attachment of earnings, the defendant should not be is unemployed or self employed, firm or limited company, in the Army, Navy or Air Force.
It means that under UK law, a self-employed, unemployed, or member of the armed forces cannot have an attachment against them. After you receive any payments from the defendant subsequent to the request you send to the court, you must tell the court immediately. The court must have knowledge of all proceedings.
